A new regulation for the Repairing Maintaining or Installation Centers of Refrigerators, and Air-conditioners.   

According to the new gazette regulation No. 1533/16 dated 25.01.2008 of the National Environmental Act No. 47 of 1980, subsequent activities are under EPL

1.   Vehicle repairing and maintaining garages including spray painting or mobile air conditioning activities.

2.   Recycling or recovering centers of refrigerants from air conditioners or refrigerators.

3.   Vehicle repairing or maintaining garages excluding spray painting or mobile air conditioning activities.

4.   Repairing, maintaining, or installation centers of refrigerators and air conditioners.

EPL PROCEDURE

1. Application Procedure

The format, for the EPL has been prescribed in Form 'B' under Schedule II in Gazette No. 595/16.

An application for the EPL shall be made

1.    Separately in respect of each prescribed activity given in the Gazette

2.    Every applicant shall furnish all such particulars whatever relevant in the said form 'A'

3.    In addition to the particulars required in form 'A' the CEA could request any further information necessary for the purposes of deciding on the application.

4.    The CEA may refer such application to an appropriate government department or public corporation (where it considers necessary) requesting that a report be submitted on such application.

2. Issuance of EPL

The EPL will be issued by the CEA or by a body that has been delegated to under Section 26 of the NEA, (eg. Part 'B' activities of the gazette No. 1533/16 by Local Authorities) only after it s satisfied that.

i. The EPL shall not be used to contravene the provisions of the NEA and its regulations

ii. No irreversible damage or hazard to man and the environment or any nuisance will result from the acts authorized by the EPL

iii. The applicant has taken adequate steps for the protection of the environment in accordance with the requirements of the NEA.

3. Licence Fee

i. Part 'A' activities issued by the CEA 15,000/= + VAT
ii. Part 'B' activities issued by the Local Authority 3,000/= + VAT

4. Renewal of EPL

There are two situations under which a EPL shall be renewed by a licencee.
i. Three months before the date of expiry of the EPL
ii. One month before effecting any changes, alterations or extensions to the premises at which the acts authorized by the EPL(s) are carried out.

The format for the EPL renewal application has been prescribed in Form 'C' under Schedule II in Gazette No. 595/16.
